The data controller is responsible for determining the purposes and means of processing personal data.
3) Obligations of the data controller
The data controller undertakes to protect the personal data collected, not to disclose it to third parties without your prior knowledge, and to comply with the purposes for which your data was collected.
In the event that the integrity, confidentiality or security of your personal data is compromised, the data controller undertakes to inform you by any means.
4) Data Protection Officer
LINGUAPHONE has appointed a Data Protection Officer (DPO). The DPO's role is to ensure proper implementation of national and supranational provisions relating to the collection and processing of personal data.

General principles of collection and processing
In accordance with the provisions of Article 5 of European Regulation 2016/679, the collection and processing of your data comply with the following principles:
- Lawfulness, fairness and transparency: data may only be collected and processed with your consent. Each time personal data is collected, you will be informed that your data is being collected and for what reasons.
- Purpose limitation: the collection and processing of data are carried out to fulfil one or more specific objectives set out in these general terms of use.
- Data minimisation: only data necessary for the proper fulfilment of the objectives pursued by the website is collected.
- Storage limitation: data is retained for a limited period of which you are informed. Where this information cannot be provided, you are informed of the criteria used to determine the retention period.
- Integrity and confidentiality of data collected and processed: the data controller undertakes to guarantee the integrity and confidentiality of the data collected.
In order to be lawful, and in accordance with the requirements of Article 6 of European Regulation 2016/679, the collection and processing of personal data may only take place if at least one of the following conditions is met:
- You have expressly consented to the processing
- The processing is necessary for the performance of a contract
- The processing is required by a legal obligation
- The processing is necessary to protect the vital interests of the data subject or of another natural person
- The processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority
- The collection and processing of personal data are necessary for the purposes of the legitimate and private interests pursued by the controller or by a third party
II. How Linguaphone manages your personal data
1) You are a visitor to our website www.linguaphone.fr
When browsing our website, we may place, depending on your cookie preferences, cookies and other trackers on your device.
Cookies enable us to personalise content and advertisements, provide social media features and analyse our traffic. We also share information about the use of our website with our social media, advertising and analytics partners, who may combine it with other information you have provided to them or that they have collected during your use of their services.

2) You have requested information about our training courses
If you submit a request for more information about our services (for example, via the contact form on our website), we ask you to provide at least the following information:
- Your surname and first name
- Your email address
- Your telephone number
- Your postcode
Legal basis for processing
This information is collected and processed in order to provide you with the information you wish to obtain, on the legal basis of your consent.
Retention period
It is retained for the period necessary to process your request and for a period not exceeding, in any event, 3 years from the last contact with our services.
After submitting an information request or registering, and with your explicit permission, we may send you emails and newsletters that we believe may be of interest to you. At any time, you can decide not to receive these emails and newsletters by unsubscribing.
3) You are a learner / trainee
Data we collect
If you choose to enrol in a training course, we need additional information in order to provide you with the best training recommendation and proposal:
- Your address, telephone number, email
- Title, age, and languages spoken
- Information about your current proficiency in the target language
- Your learning objectives
- Your schedule constraints
- Your learning preferences and any other information necessary for your support
- Payment and billing data
- Data relating to the monitoring of your training (attendance sheets and connection data for the learning platform)
If you choose to undertake a language immersion stay abroad, we may ask you to provide a copy of your identity card or passport (this data is deleted from our databases at the end of your stay).
Legal bases for processing
This data is processed and collected on the legal basis of the conclusion or performance of a contract or compliance with our legal obligations.
Retention periods
Most of your data is retained for a period of 5 years following the end of your training, for evidentiary purposes and for the applicable limitation period. Data not necessary for the pursuit of these objectives is anonymised 3 years after the end of your training.
Sharing your data (Learner)
After validation of your training pathway, we will share the relevant information with selected salaried or freelance trainers, so that they can best adapt the training to your needs. The information we share includes your name, age, contact details, title, learning objectives, current proficiency in the target language, the training module requested, the duration and dates, and any voluntary information you have provided that may be relevant. Trainers are not authorised to use your contact details for purposes other than those directly related to your training.
In the case of a language immersion stay outside Europe, we will also transmit your registration and confirmation data to our partners. They are authorised to use your contact details solely for purposes directly related to the organisation of your language stay. Once the stay is completed, local organisers delete any personal data they may have used.
We will not share your personal information with others for marketing purposes unless you have explicitly given us your permission.
We may use service providers to help us manage our business operations, some of whom may be based outside the EEA. Any organisation that accesses your information in the course of providing services on our behalf will be governed by strict contractual restrictions to ensure that they protect your information and comply with applicable data protection and privacy laws.
Training funded via the CPF
For training funded through the Personal Training Account (CPF), we may collect and transmit personal data for the purposes of administrative management, certification and fraud prevention, such as:
- surname, first name, date and place of birth
- contact details (address, email, telephone)
- where applicable, administrative identifiers necessary for identity verification (including the pseudonymised social security number via the RNIPP — Répertoire National d'Identification des Personnes Physiques)
This data is transmitted solely to partner certifying bodies and to the Caisse des Dépôts et Consignations (CDC), which manages the "Mon Compte Formation" platform, for verification, validation and issuance of the final certification.
4) You are a trainer or applicant for a trainer position
Data we collect to review your application
We collect information about you when you apply for a trainer position and when you enter into a contract with us.
- Your name
- Your email address
- Your telephone number
- Your date of birth, gender and home address
- Your current or most recent occupation
- Details of your qualifications and experience, including evidence or certificates where applicable
- Details of your language training skills
- Details of your personal interests
- Details of two references we may contact
Additional data when you enter into a contract with us
- Proof of identity and your right to work in your country of residence
- Your bank details
- Social Security and URSSAF number
- Remuneration
Legal bases for processing
The collection of your data during the review of your application is based on the legal basis of the performance of a contract or pre-contractual steps. The collection of additional data when you enter into a contract with us is based on the performance of a contract and our legal obligations.
Retention periods
If we do not receive any communication from you over a period of two years, we will contact you to check whether you still wish to remain registered as a trainer. If you do not respond to this request, we will permanently delete your personal data, with the exception of data necessary to maintain internal records of courses delivered: your name and email address. We will also retain other data for as long as necessary to comply with our legal obligations (for example, payment data).
Sharing your data (Trainer)
Your anonymised CV may be shared with our clients or in response to a call for tenders. The information provided in your profile does not include your address, telephone number, email address or surname. It focuses on your personal and professional background relevant to the requested course content.
Your contact details may be passed on to learners who are not authorised to use them for purposes other than those directly related to their course of study with you.
We will not share your personal information with third parties for marketing purposes unless you have given us your permission.
Data we share with you
When contacting you regarding potential training, we will share certain information about the learner with you: their name, age, language needs, preferences and availability. Once you confirm the training, we will provide further details: their email address, telephone number and training location.
Under data protection law, you are responsible for the security of this data. You must not use the information provided for purposes other than those directly necessary for the training entrusted to you. You must not share learner data with any other third parties.
5) Where is your personal data processed and hosted?
The website www.linguaphone.fr is hosted by Vercel Inc., whose registered office is at the following address:

Vercel is GDPR-compliant. Server functions are deployed exclusively in European regions (Paris, Frankfurt, Dublin). Data collected and processed by the website is hosted and processed within the EU.
6) Your rights regarding your personal data
Under personal data regulations, you have the following rights:
- Right of access: you may obtain disclosure of all data concerning you held by Linguaphone.
- Right to object: you have the right to object to the processing of your data by the website, and the website may not refuse, unless it demonstrates the existence of legitimate and compelling grounds which may override your interests, rights and freedoms.
- Right to restriction: you have the right to request restriction of the processing of your data by the website, and the website may not refuse, unless it demonstrates the existence of legitimate and compelling grounds which may override your interests, rights and freedoms.
- Right to rectification: you may update or correct personal data concerning you held by Linguaphone.
- Right to erasure: you have the right to request the erasure of personal data concerning you held by Linguaphone.
- Right to data portability: you have the right to obtain the transfer of your personal data held by the website in a structured format, or the transfer thereof from one data controller to another.
- Right not to be subject to a decision based solely on automated processing: in accordance with the provisions of Regulation 2016/679, you have the right not to be subject to a decision based solely on automated processing if the decision produces legal effects concerning you, or similarly significantly affects you.
- Right to determine the fate of your data after death: you are reminded that you may make arrangements for what should happen to your collected and processed data in the event of your death, in accordance with Act No. 2016-1321 of 7 October 2016.
- Right to lodge a complaint with the competent supervisory authority: in the event that the data controller decides not to respond to your request, and you wish to challenge that decision, or if you believe that any of your rights listed above has been infringed, you are entitled to lodge a complaint with the CNIL (Commission Nationale de l'Informatique et des Libertés, https://www.cnil.fr) or any competent court.

In order for Linguaphone to verify that the request originates from the person concerned by the personal data, you may in certain cases be asked to provide a copy of an identity document. Linguaphone undertakes to respond to your verified request within one month of receipt. If necessary, this period may be extended by two months, taking into account the complexity and number of requests.
In the event of difficulty, you may contact our Data Protection Officer directly by email: dpo@linguaphone.fr or lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL).
7) Personal data of minors
In accordance with the provisions of Article 8 of European Regulation 2016/679 and the French Data Protection Act (Loi Informatique et Libertés), only minors aged 15 or over may consent to the processing of their personal data.
If you are a minor under the age of 15, the consent of a legal representative will be required in order for your personal data to be collected and processed.
The website publisher reserves the right to verify by any means that you are over 15 years of age, or that you have obtained the consent of a legal representative before browsing the website.
In all cases, Linguaphone will never process the data of minors under the age of 15.
III. Conditions for amendment of the privacy policy
